At Faith Williams Law our civil dispute resolution specialists seek to resolve our clients disputes. Alternative civil dispute resolution is being heavily pushed by the courts and in fact the parties must declare on court documents whether they would like a month’s stay of the court proceedings to attempt to settle the issued claim by alternative means.

What can you expect?

When you initially comes to us for advice regarding civil dispute resolution, we will evaluate the claim, whatever it may be, and advise you on the next steps that should be taken.

In order to be able to do this, we must read through all the relevant documentation received from you and formulate an opinion on the your potential for a successful outcome.

It is possible that we might advise you that your claim is not a particularly strong one and therefore you should try and settle it as soon as possible. Alternatively, we might advise you that a claim that has been issued against you is weak and that you have a good defense.  Our civil dispute resolution specialists will always look at what is the best possible course of action for you to take, and we have an obligation to advise you if your claim would cost you more that you could possibly receive.

We may if the course of action requires it issue court proceedings and deal with disclosure and drafting witness statements.  There is also a possibility that we could instruct Counsel to attend the trial, prepare trial bundles and all the documentation required by the court both pre-trial and post-trial.

If required we can attend conferences with Counsel and you to discuss the civil dispute resolution case, proceedings and preparations. During a trial we will act in a duel capacity to assist with Counsel and answer questions or give instructions, and also to ensure that you understand whats happening and keep you updated in plain English.

Litigation can be daunting and we will look to manage you through this with empathy and assist with your understanding of the legal proceedings, we are here to listen at all times and not to push you through unnecessary procedures.
