Complaints
We are committed to providing high quality legal advice and client care. If you are unhappy about any aspect of the service you receive or about any invoice, please contact Faith Williams in the first instance so an investigation into your complaint can be undertaken in attempt to resolve the matter.
In the event that you are still not satisfied, then you are entitled to ask the Legal Ombudsman to consider the complaint. The Legal Ombudsman can be contacted at: Po Box 6806, Wolverhampton, WV1 9WJ On 0300 555 0333 Or at, www.legalombudsman,org.uk
Normally, you will need to bring your complaint to the ombudsman within 6 months of receiving your final decision from Faith Williams Law regarding the complaint or within a year of the act or omission about which you are complaining (or you are becoming aware of it).
Equality and Diversity
Faith Williams Law is committed to promoting equality and diversity in all its dealings. Faith Williams Law operates a policy for Equality and Diversity to all its employees and they are obliged to follow the same. For the purpose of anyone who has a disability that makes attending the office of Faith Williams Law, then the employees of Faith Williams Law can at no additional cost to the Client, attend their home for all necessary interviews and meetings.
In the event that a formal meeting with another party is necessary and where normally such a meeting would be conducted at Faith Williams Law premises, then Faith Williams Law can arrange a suitable venue at their own cost so that appropriate facilities can be provided. Any dispute arising from these Terms of Business will be determined by the law of England and Wales and considered exclusively by the English and Welsh Courts.
Terminating your Instructions
You may end your instructions at any time, by giving Faith Williams Law notice in writing. We reserve the right to retain all your papers and documents whilst there are charges and/or disbursements/expenses outstanding on your matter.
Faith Williams Law may stop acting on your behalf with good reason and provided that we give you reasonable notice. Examples of goods reason are not complying with the terms and conditions set out in these Terms of Business and Letter of Engagements, failing to provide us with your instructions, failing to meet our charges, failing to comply with our instructions, requesting us to undertake matters which are not within our competence and/or are in breach of any English and Welsh Law, any rule or regulation for which we are obliged to comply with or against an Order of the Court. This list within the example is not exhaustive, but should it be the case that we must terminate your instructions, we will give full details at that time.
If you decide that you wish to terminate your instructions, then you are liable to pay all charges and disbursements/expenses up until that point. These are calculated on the basis set out in Faith Williams Law Letter of Engagement.
Prevention of Money Laundering, terrorist financing and bribery.
Faith Williams Law is required by law to obtain satisfactory evidence of the identity of all clients and sometimes people related to them. This is because Solicitors who deal with money and property on behalf of their clients can be used by criminals wanting to launder money.
So as that Faith Williams Law and its employees are fully complaint with the Law, rules and regulations in relation to Money Laundering, Crime Prevention, Terrorism and Bribery, we will request evidence of your Identification at the onset of any matter.
This Identification will be copied and retained on your file. In order that Faith Williams Law, its employees, agents, associates, and Clients cannot be implicated in any form of bribery and or corruption, we have a standard policy for all gratuitous gifts.
Should you feel the need to provide a gratuitous gift to an employee of Faith Williams Law, then please ensure that it does not exceed a value of £30.00 and that it is not a cash form of gift. Faith Williams Law appreciates that often clients want to say thank you for work undertaken and for a service that they have received at the conclusion of a case and this reward is greatly received. However, we must ensure that as a Firm, we do not risk any of our employees or you as a client being accused or put into a position where they may be accused of accepting or making bribes to one another.
Faith Williams Law is professionally and legally obliged to keep your affairs confidential. However, sometimes it is necessary and required by statute to make disclosure to the Serious Organised Crime Agency where they know or suspect that a transaction may involve money laundering or terrorist financing. If Faith Williams Law Limited makes a disclosure on any matter, you will not be informed or given notice. This is as it is a criminal offence for Faith Williams Law or any of its employees to notify you of such a suspicion, it is known as ‘Tipping Off’.
Confidentiality
The information and documentation you provide to Faith Williams Law is confidential and subject to legal professional privilege unless:
- Stated otherwise in this document or the Letter of Engagement, for example to prevent money laundering and terrorist finance.
- We advise you otherwise during the course of your matter We cannot absolutely guarantee the security of information communicated by email, mobile phone or other electronic and interactive.
Unless we hear from you otherwise, it is assumed that you agree to the use of such methods of communication.
Regulated Services
Faith Williams Law is authorised and regulated by the Solicitors Regulation Authority (“the SRA”), Ipsley Court, Berrington Close, Redditch, B98 0TD. This means Faith Williams Law and its employees are strictly regulated and governed by a Code of Conduct and other professional rules. These can be viewed publicly on the SRA website, being www.sra.org.uk or by calling 0870 606 2555.
Data Protection
Faith Williams Law will use the information you provide primarily for the provision of legal services to you and for related purposes including:
- Updating and enhancing client records
- Analysis to help manage the Firm
- Statutory Returns
- Legal and Regulatory Compliance
Faith Williams Law use of that information is subject to your instructions, the General Data Protection Regulations (GDPR) and the Firm’s responsibility and duty to comply with strict confidentiality. Please note that your information will be passed to other parties directly involved with the case, such as Expert Witnesses, the Court and other professional advisers, as is required to be disclosed by any Law or Procedure so as that compliance can be achieved.
Your Information will not be passed to any third parties outside of your case. The firm reserves the right to make a small charge for the administration and copying charges for providing such Information. Please be advised that Faith Williams Law is registered with the Information Commission Office to hold information, as is required by the GDPR.
